We Bought An RV From A Guy Who Went Bankrupt. Court Has Ordered Us To Give RV Back

by Abby
(Idaho)

We bought an RV from a guy at an auction. We paid for the RV and the taxes that day. We did not have the title transferred into our names and now the guy has filed bankruptcy and the courts want us to give the RV back. What can we do?

ANSWER Hi Abby, I am very sorry to hear that you are going through this. Unfortunately, I am not an attorney and would not even attempt to give you legal advice on this issue. You are going to need to hire an attorney immediately to get this resolved. I am not sure how much you paid for this RV at auction, but you are now going to have to add legal costs into the purchase price of the RV.

You do not say what type of auction you bought the RV from. Was it at an auto auction? Was this guy in charge of the auction? If you bought this at an auction run by an established auction company, you may have some legal recourse against that auction company, but only an attorney can tell you if you have a case. If the person that you bought this RV from was running the auction, you may be out of luck.

It is important that you give all the paperwork that you got from the auction to your attorney.

You might also want to go to the State Of Idaho Consumer Protection Department Website and see if there is some information there that could help you. Or you may want to call them at 1-800-432-3545.

I am sorry that I could not be of more help to you. I really hope that you get this situation resolved. As always if any of our visitors have any suggestions for you, they can leave a comment on this page by clicking on the add a comment link near the bottom of this page.

Best of luck to you.
